Terms and Conditions

At Layton Education, we aim to have complete clarity for clients and pupils when commencing lessons with us. Detailed information can be found below and in your agreement.

Note: Layton Education reserves the right to make changes to these terms and conditions as found on the website.

​Definitions:

  • “Client(s)” = refers to any individual, parent, guardian, or payee responsible for or involved with the pupil.

  • “Pupil(s)” = refers to any individual or child who is receiving tuition.

  • “Layton Education(s)” = refers to any individual who is providing tuition or services.

Agreement and Personal Information

  • Clients must read and sign the agreement at the beginning of the second lesson, after the trial lesson. The agreement contains details about payments, cancellations and responsibilities.

  • All clients must read and familiarise themselves with the Data Protection Policy, Privacy Notice and Safeguarding and Child Protection Policy, as found on the website.  

  • It is the client’s responsibility to provide up-to-date contact details (email address and contact number).

  • It is the client’s responsibility to inform Layton Education of any allergies, special educational needs or medical concerns relating to the pupil.

 

Invoices and Payment/Charges

  • ​Lessons are charged as per the rates on this website and as discussed at the time of enquiry. Note: All fees are set and are not open to negotiation. Lesson prices are reviewed annually and subject to change. Four weeks’ notice will be given in writing for any fee changes.

  • Payments are made monthly before the start of the commencing tutoring month via bank transfer. Clients will receive an invoice detailing their lessons for the upcoming month and the total due. Payments must be made by the 28th of each month and lessons will not commence until the full month’s payment has been made. Ad-hoc lessons must be paid by the due date on the invoice.

  • Payment for the lessons should be done via bank transfer, details on how to do this are provided on the invoices sent to you. Note: We do not take cash for any transactions.

 

Cancellations, Notice and Missed Lessons

  • Clients are subject to one free cancellation per three months for a cancellation made over 48 hours before the lesson. Any cancellation made less than 48 hours before a booked lesson is subject to the lesson fee of £30. Any cancellation made within 48 hours of an ad-hoc lesson is non-refundable.

  • The three month cancellation cycle runs as: Sep-Nov, Dec-Feb, Mar-May, Jun-Aug. August is treated as an ad-hoc month where the above cancellation rules do not apply. All lessons in August are pay-as-you-go in order to factor in holidays.

  • All other cancellations are non-refundable apart from exceptional circumstances, which are independently reviewed.

  • Any paid cancellations are rescheduled at tutor discretion and where availability allows.

  • Any lessons that the tutor cannot attend due to illness will be credited, and tutor annual leave will not be billed.

  • Cancellations can be made up to 48 hours before a lesson via email. Any cancellation made within 48 hours of a lesson needs to be made via direct contact to the number supplied on the agreement.

  • Four weeks’ notice is required by clients for the termination of lessons. Verbal and written notice will be confirmed by Layton Education via email. Layton Education reserves the right to terminate lessons.

  

Tutor Responsibility

  • Layton Education reserves the right to cancel lessons without notice if it is deemed that the environment is not suitable/fit for purpose, or if abusive/threatening behaviour is experienced.

  • The tutor does not accept any responsibility for loss or damage that occurs if the environment is deemed unsuitable or not fit for purpose.

  • The tutor reserves the right to contact the relevant authorities if there is a safeguarding concern regarding a client.

Client Responsibility and Pupil Conduct

  • It is the client’s responsibility to provide a safe environment for the child during their tutoring sessions.

  • For pupils under the age of 13, a parent/guardian is required to be present within the property for the full length of the lesson. If the parent/guardian leaves the property, the lesson will be ceased immediately and the lesson payment will not be refunded.

  • Layton Education will always endeavour to have a professional, friendly, respectful and courteous manner when working and communicating with all clients/parents/guardians and students. It is expected that clients/parents/guardians will also maintain this standard of manner.

  • It is important that clients work in conjunction with Layton Education to tackle any low-level behaviour that the pupil may engage in. This may include behaviour such as excessive talking, refusal to work or low levels of participation in the lesson.

  • It is important that the pupil comes ready to work in the lesson. If a pupil consistently engages in unacceptable behaviour, lessons will be terminated.

  • If a pupil is neurodivergent and has a neurodevelopmental condition such as ADHD (Attention Deficit Hyperactivity Disorder), the client must declare this information before lessons begin, so that the tutor can collaborate with the client to identify the best strategies for the pupil within the lessons.

  • At Layton Education, there is a zero policy for high level unacceptable behaviour (from a client or pupil) that has resulted in aggressive, rude behaviour or violence of any sort. This includes behaviour such as: swearing, physical violence, name calling or the use of racist/homophobic/sexist/or antisemitic terms. This behaviour will result in instant termination of lessons and no money will be refunded for any lessons that have been pre-paid.  

  • At Layton Education, we do not film, photograph or record any of our pupils or any portion of the lessons. This is in line with our data protection policies. Likewise, it is unacceptable and against GDPR (General Data Protection Regulations) for clients to record or film the tutor or any portion of the lesson. Any client that is known to have done this will risk an instant termination of lessons and no refund will be allocated in this case.

  • It is the pupil’s responsibility to come to the lesson with all the necessary materials needed, such as textbooks, plays or novels. This also includes any homework that has previously been set for the pupil to complete. Pupils are welcome to use any equipment, such as pens and rulers, that the tutor provides, however they must return them to the tutor at the end of the lesson.

  • During the lesson, the client must not participate in the lesson or distract the student. They should respect the tutor's expertise and allow the lesson to take place in a naturalistic way. This ensures that the focus remains on the student's learning process and allows the tutor to effectively deliver the lesson without interruptions or interference.

Feedback

  • At Layton Education, we believe that giving feedback is an important component for students to be able to gain positive learning experiences.

  • We always aim to give feedback in a way that is supportive, fair, constructive and beneficial for the student to be able to act upon and learn from it. It is equally important that students accept the feedback graciously and be willing to learn and act on it.

  • These terms and conditions have been put in place to support the pupil’s learning and to help them succeed academically. Following the terms and conditions, policies and agreement allows clients and pupils to maximise the tutoring lessons in an orderly, supported way.
